Welcome to OzWheels. These Terms and Conditions govern your use of the OzWheels website (https://ozwheels.com.au) and our car and motorcycle rental services. By accessing our website or using our services, you agree to these Terms and Conditions in their entirety.

1. Definitions

Throughout these Terms and Conditions, the following terms shall have the meanings defined below:

• "OzWheels", "we", "us", or "our" refers to OzWheels, a company registered in Australia with registration number 79333552.
• "Website" refers to the website operated by OzWheels at https://ozwheels.com.au.
• "Services" refers to the car and motorcycle rental services provided by OzWheels.
• "Vehicle" refers to any car, motorcycle, or other vehicle rented through OzWheels.
• "Customer", "you", or "your" refers to the individual or entity entering into a rental agreement with OzWheels.
• "Rental Agreement" refers to the contract between OzWheels and the Customer governing the rental of a Vehicle.

2. Eligibility Requirements

2.1. Age Requirements

To rent a car from OzWheels, you must be at least 21 years of age. For luxury vehicles and motorcycles, the minimum age is 25 years. Drivers under 25 may be subject to a young driver surcharge.

2.2. Driver's License Requirements

All drivers must possess a valid driver's license that has been held for a minimum of 12 months. International customers must have a valid international driver's license or permit along with their original driver's license.

2.3. Motorcycle License Requirements

For motorcycle rentals, customers must possess a valid motorcycle license appropriate for the class of motorcycle being rented.

2.4. Payment Method

A valid credit card in the renter's name is required for all rentals. The credit card will be used for the security deposit and any additional charges that may arise.

3. Reservations and Booking

3.1. Reservation Process

Reservations can be made through our website, by telephone, or in person at one of our locations. All reservations are subject to vehicle availability.

3.2. Required Information

To complete a reservation, you will need to provide personal information including your name, contact details, driver's license information, and payment details.

3.3. Confirmation

Once your reservation is confirmed, you will receive a confirmation email with the details of your booking. This confirmation is not a guarantee that a specific vehicle make or model will be available.

3.4. Pricing

All prices are quoted in Australian dollars (AUD) and include GST. Prices are subject to change without notice. The final price will be confirmed at the time of booking.

4. Vehicle Pick-up and Return

4.1. Required Documents

At the time of vehicle pick-up, you must present:

• A valid driver's license
• The credit card used for the reservation
• A form of identification (passport for international customers)
• Your booking confirmation

4.2. Vehicle Inspection

Before accepting the vehicle, you should inspect it thoroughly and report any existing damage to our staff. Any pre-existing damage will be noted on the Rental Agreement.

4.3. Late Pick-up

If you will be late for your scheduled pick-up time, please notify us as soon as possible. We will hold your reservation for up to 2 hours after the scheduled pick-up time, after which the reservation may be canceled without refund.

4.4. Return Procedure

Vehicles must be returned to the designated location at the agreed time. The vehicle must be returned with the same amount of fuel as when it was picked up unless a prepaid fuel option was purchased.

4.5. Late Return

Late returns will incur additional charges. If you know you will be returning the vehicle late, please contact us as soon as possible to extend your rental period.

5. Payment and Security Deposit

5.1. Payment Methods

We accept payment by credit card (Visa, MasterCard, American Express). Debit cards may be accepted in some cases with additional requirements.

5.2. Security Deposit

A security deposit will be pre-authorized on your credit card at the time of vehicle pick-up. The amount varies depending on the vehicle type and rental duration. This deposit will be released upon the satisfactory return of the vehicle, subject to any additional charges.

5.3. Additional Charges

Additional charges may include, but are not limited to:

• Fuel replacement costs
• Cleaning fees (if the vehicle is returned excessively dirty)
• Traffic or parking fines incurred during the rental period
• Toll road charges
• Damage repair costs not covered by insurance
• Late return fees

6. Insurance and Liability

6.1. Basic Insurance Coverage

All rentals include basic insurance coverage. This coverage has a standard excess (deductible) amount that varies depending on the vehicle type.

6.2. Excess Reduction Options

We offer various excess reduction options that can be purchased at the time of rental to reduce or eliminate your liability in case of damage or theft.

6.3. Insurance Exclusions

Our insurance policies do not cover:

• Damage caused by negligence or violation of the rental agreement
• Damage to tires, windscreen, or undercarriage unless specific coverage is purchased
• Personal belongings in the vehicle
• Damage caused while driving under the influence of alcohol or drugs
• Damage caused while using the vehicle for prohibited purposes

6.4. Customer Liability

You are responsible for all damage to the vehicle during the rental period up to the excess amount specified in your rental agreement, unless you have purchased excess reduction options.

7. Vehicle Use Restrictions

7.1. Authorized Drivers

Only drivers listed on the Rental Agreement are permitted to drive the vehicle. Additional drivers must be registered at the time of rental and meet all eligibility requirements.

7.2. Geographic Restrictions

Vehicles may only be driven within Australia. Some vehicles may have additional geographic restrictions, such as off-road prohibitions or restrictions on traveling to certain areas.

7.3. Prohibited Uses

The following uses of the vehicle are strictly prohibited:

• Driving under the influence of alcohol, drugs, or any other substance that impairs driving ability
• Transporting illegal substances or contraband
• Using the vehicle for any illegal purpose
• Racing, speed testing, or competitive driving
• Towing another vehicle unless the rented vehicle is designated for towing
• Commercial use, including transporting people or goods for hire
• Off-road driving unless in a vehicle designated for such use and with explicit permission

7.4. Smoking Policy

Smoking is not permitted in any of our vehicles. A cleaning fee will be charged if evidence of smoking is found in the vehicle.

8. Breakdowns and Accidents

8.1. Roadside Assistance

24/7 roadside assistance is included with all rentals. In case of a breakdown, contact our emergency assistance number provided in your rental documentation.

8.2. Accident Procedure

In case of an accident, you must:

1. Ensure the safety of all passengers and other parties involved
2. Contact emergency services if necessary
3. Report the accident to the police if required by law
4. Notify OzWheels as soon as possible
5. Collect information from all parties involved (names, contact details, insurance information)
6. Take photographs of the damage and accident scene if possible
7. Complete an accident report form provided in the vehicle

8.3. Liability for Damage

You are responsible for any damage to the vehicle during the rental period, subject to the insurance coverage and excess applicable to your rental.

9. Cancellations and Modifications

9.1. Cancellation Policy

Our cancellation policy is as follows:

• Cancellations made more than 48 hours before the scheduled pick-up time: Full refund
• Cancellations made between 24-48 hours before the scheduled pick-up time: 50% refund
• Cancellations made less than 24 hours before the scheduled pick-up time: No refund

9.2. Reservation Modifications

Modifications to existing reservations are subject to vehicle availability and may result in price adjustments. We will accommodate modification requests whenever possible.

9.3. Early Returns

If you return the vehicle earlier than scheduled, you may not be eligible for a refund for the unused rental period.

10. Privacy and Data Protection

Your personal information is collected, stored, and used in accordance with our Privacy Policy, which is available on our website. By using our services, you consent to our collection and use of your personal information as described in the Privacy Policy.

11. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of OzWheels or our content suppliers and is protected by Australian and international copyright laws. Unauthorized use of any materials on our website may violate copyright, trademark, and other laws.

12. Limitation of Liability

To the maximum extent permitted by law, OzWheels shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with these Terms and Conditions or the use of our services.

13. Indemnification

You agree to indemnify, defend, and hold harmless OzWheels, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms and Conditions, or your violation of any rights of a third party.

14. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia. Any dispute arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Australia.

15. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions.

16. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with the Rental Agreement and our Privacy Policy, constitute the entire agreement between you and OzWheels regarding our services and supersede all prior agreements and understandings, whether written or oral.
